Should parent be responsible for paying retroactive child support?

In my state no child support is required until the court says so. You don't have to wait for a divorce to become final in my state to get a ruling on support, so the court will say the CP missed their chance by not applying previously. BTW once one spouse walks out the door the other can immediately apply for child support and a separate maintenance agreement, at least in my state.
